Freedom of expression under attack in Brazil?
Freedom of expression is a natural right. It is normally confirmed where the Rule of Law is not the law of the ruler.
The Brazilian Constitution expressly sustains this fundamental individual right. And disallows any and all forms of censorship.
The Brazilian Supreme Court is a constitutional and the final court of the judiciary branch.
It is within its judicial competence the safeguard of our constitutional rights.
Unfortunately, under its present composition, the Court has been acting beyond its constitutional limitations. As if it were a political tribunal.
As a consequence thereof, individuals and business companies have been submitted to trial therein in total disregard of their constitutional rights to the proper venue before their natural judge, the right of a fair trial and to appeal to the upper courts.
However, any court decision in offense of any of our natural and constitutional rights is totally null and void.
And this disagreement of its victims - I would dare to say – must be stated by means of a simple petition to the Court, named intermediary petition, sustaining the total invalidity of its decision in any case where the right to a lower and proper venue be denied to the defendant.
The full Court has the power to review its own decisions.
